On January 17, 2015, Miller attended a party at Stanford University’s Kappa Alpha Fraternity. Brock Turner, a freshman at Stanford on a swimming scholarship, was also present at the party. He was 19 years old at the time. At the party, the two got along well while drinking beers and dancing. They then left the party around 1 a.m. on January 18, 2015, to return to his dorm. They were walking together, holding hands. Miller slipped on a slope behind a wooden shed behind a dumpster, and Turner knelt down and began kissing Miller. Turner asked Miller if she wanted to “finger” her, to which she replied in the affirmative. For a minute, Turner “fingered” Miller.

Turner was discovered on top of Miller by two Swedish graduate students while she was unconscious. Turner fled the scene after they confronted him. One student pursued Turner, while the other checked to see if Miller was breathing. Turner was grabbed and held to the ground by the students until campus police arrived and arrested him.

Miller was taken to the hospital and regained consciousness at 4:15 a.m. Miller had significant trauma and penetrating trauma, according to a nurse who administered a Sexual Assault Response Team examination at the hospital. Miller stated that she had no recollection of the incident. She also stated that she had no recollection of phone calls to her sister. Before being taken away by ambulances, she had vomited on the scene.

Charges of Sexual Assault

  • On January 20, Stanford barred Turner from campus, and USA Swimming barred Turner from ever competing in a competitive swimming event for the United States.
  • Turner was charged with two counts of rape, two counts of penetration, and one count of assault with intent to rape on January 28, 2015, as a result of the investigation.
  • DNA analysis revealed no genetic evidence of genital-to-genital contact. As a result, the two rape charges were dropped at a preliminary hearing on October 7, 2015.
  • The trial People v. Turner began on March 14, 2016, at the Santa Clara County Superior Court. Turner was convicted of three felonies on March 20, 2016, including assault with intent to rape an intoxicated woman, sexually penetrating an intoxicated person with a foreign object, and sexually penetrating an unconscious person with a foreign object.
  • Turner was sentenced to six years in prison by prosecutors. On June 2, 2016, Judge Aaron Persky sentenced Turner to six months in the Santa Clara County Jail, followed by three years of probation. Turner was labeled a sex offender for the rest of his life.
  • Turner was imprisoned in Santa Clara County for three months. On September 2, 2016, he was released.
